The court case brought against the Environmental Protection Agency on the practice of adding fluoride to the public water supply was first filed in 2017. The US District Court finally came to a decision in September 2024, after nearly 8 years of litigation. What happened during that time? While the case itself barely made headline news, it seemed to be keeping public health agencies up at night. This is a case of when the science conflicts with current public health policy, and the measures these agencies will take to prevent it from happening.

In my previous streams on water fluoridation, I reviewed the primary scientific literature surrounding the toxicity of fluoride exposure. The findings in these studies suggest that the current regulatory water fluoride levels set in place by the EPA are much too high. These levels have been shown to correlate with lower IQ in children at statistically significant margins.

One of the most comprehensive studies on water fluoridation and its effect on mental health was the National Toxicology Program’s “Monograph on the State of the Science Concerning Fluoride Exposure and Neurodevelopment and Cognition: A Systematic Review.” But the work behind this monograph started in 2016, and it was finally published in August of 2024. One of the questions I asked during my first stream was: why did it take so long?
The events surrounding this court case answer this question. But more importantly, the case calls into question whether some of these US Public Health Agencies are acting in the best interest of the general public.
