J.D. - A Lawyer Explains

On this channel we explain legal topics and do analyses of current trials. My goal is to explain complex legal topics in ways that don't require you to have a Latin-to-English dictionary. Why?
The law can be an astoundingly complex thing. For any question there are multiple possible answers. My job is to explain things in plain language.
Importantly, this channel DOES NOT provide legal advice. It is a general description of the law based on 28 years of legal practice, hundreds of case, and lots of experiences. As a lawyer I have written a legal column for more than 25 years and am published in a wide variety of publications. I have several books published both in hardback and in Kindle format.

DO NOT RELY ON THE VIDEOS HERE. CONSULT A LAWYER IN YOUR JURISDICTION.

When comments are turned off on a video, I can be contacted off-line at aldewitt7@gmail.com. Your comments are welcome on here but please keep them clean.

So, yesterday as I was watching fireworks YouTube said I had a copyright claim on my use of the National Anthem. I do not believe it was a legitimate claim, but rather than fight it, I just re-uploaded it with a different tune by a different military band. I am sorry if your comments were lost. I read many of them.

J.D. - A Lawyer Explains

As I mentioned in my Postscript video, I need some time today to take care of some chores around the house and help my wife out with a few things. So today's Postscript video will likely be the only one I release.

Several of you have referenced the Kouri Richin's Motion for New Trial and Judge Mrazik's recusal from its consideration. Don't worry about it. As I will explain tomorrow, this is like the child who murders both parents and then throws himself on the mercy of the court because he's now an orphan. They make clueless claims of bias without taking into consideration their own rude and surly behavior. I don't think the judge's demeanor was important to the jury; I think they made their decision on the evidence and the hideous attempts by these lawyers to portray a dead man as having a same-sex affair.

I will have a Postscript to the Taylor trial tomorrow. Glad to see the Jury found enough evidence to convict. I am hoping for a significant sentence.

For some reason YouTube is having a brain fart on my Defense Closing Video. I will publish it as soon as it releases. Until then, I will put up the Rebuttal Close.

So, I did a video today on the Hildebrand case in Alaska, but that case has gone on too long to consider a series. So tomorrow I pick up on Blaise Taylor in Tennessee and he is charged with poisoning his pregnant girlfriend. I promised I would let y'all know when I was going to do another case.

Pino was found not guilty. Rather than looking at the rebuttal argument, I will do a Postscript video on this tomorrow. Then…on to the next one.

Judging from the states, closing argument, and from what I have heard of the defense, closing argument, this is shaping up to be quite the slugfest in the George Pino Trial. I will have full analysis after both arguments are finished.

Big storms in my area tomorrow, pretty much all day. We're set to get 3 inches of rain, which means my power will be off at some point tomorrow. If I don't post a video, that will be the reason.

This came by email today from someone who I believe is NOT a subscriber:

Homilyzing" (or homilizing) means to deliver a homily—a brief, practical sermon or moral lesson. It usually focuses on a scriptural text or provides advice on how someone should behave, although it can sometimes take on a slightly negative tone when it sounds like a tedious lecture.
(- from SI sources)
Being effusive in thanking a person for doing her or his job can be creepy. Seeking out the person's direct boss or employer is even more creepy, icky, maybe even frightening. Either way, you are presenting your own self as a "really good guy" and
that is being more performative than appreciative. A nice smile and a simple thank you to the employee is enough.

Please do me a kindness and answer the following question: Is a simple thank you enough, and is passing along compliments performative?
