IN OVER SMART ACTION ACCUSED GIVES OWN EVIDENCE. It becomes admission since can be easily contradicted by simple cross.

Accused should disprove the complaint and should not attempt to give own evidence to win.

In view of 15 March 2019 SC judgment = cheque accused should be carefull from day one to raise only technical issues to win the case.

SC in reccent 15 march 2019 judgment has confirmed the PRESUMPTION in cheque cases and normal defense of cash loan, no source , no ITR and no entry in accounts have rejected.

Accused should technical defense to win and not such stale defense which are rejected by higher courts.
