Magistrate Tlakale Sathekge ruled that the interests of justice demand he remain behind bars, citing him as a severe flight risk due to his elite tactical and marksman training. The court also noted a high likelihood that his release could compromise witness safety and evidence integrity. Facing Schedule 6 offences, Sotheni failed to establish any exceptional circumstances for release.
Here is a breakdown of the case background: Sotheni faces 16 criminal charges, including premeditated murder, conspiracy, and unlawful possession of a firearm and ammunition. He is the alleged shooter in the December 2025 attack on Marius van der Merwe (known as "Witness D"), who tragically lost his life outside his Brakpan home. Given how many of you asked about parental accountability after my first breakdown, I wanted to jump on here and share exactly why prosecutors made this decision based on the evidence: β’ π The Weapon's Origin: Investigators confirmed the Smith & Wesson .38 Special revolver used in the attack was an old family heirloom originally belonging to one of the shooter's grandparents. β’ π οΈ Secured Storage: The firearm was kept inside a locked gun safe. Forensic evidence and DNA analysis showed no signs that the parents gave him access or negligence on their part. β’ π How He Got It: Authorities believe the shooter may have secretly slipped the heirloom out of the safe entirely unnoticed while helping his father clean other firearms at an earlier date. A Plettenberg Bay artist, Bevan van Druten (53), has been charged with the murder of former detective Nicky van Heerden (54), who was found dead at Keurbooms Beach.
Prosecutors say the case is being treated as femicide.
The court has also heard that at least six women previously sought protection orders against Van Druten, with allegations including harassment, intimidation and threats. He remains in custody, with bail expected to be opposed, and returns to court on Monday.
