Justice with Heather

Welcome to Justice with Heather — a true story unfolding in real time.

This channel documents the ongoing pursuit of legal accountability in Pierce County Superior Court, where a signed probate order from 2016 — confirming the heirs of my late mother — mysteriously vanished from the public record.

Despite being signed by Judge Karena Kirkendoll and intended solely to establish heirship for copyright succession, the order was never filed by the Pierce County Clerk’s Office under then-clerks Lu Ellen Scott and Kevin Stock (both of whom have since left or retired early).

Nearly a decade later, the Clerk’s Office still refuses to docket the order — leaving a family without legal clarity, and a fourth generation unable to honor and republish the century-old works of their great-grandparents.

This is more than a probate dispute. It’s about recordkeeping, power, and what happens when the government erases the truth.

Subscribe to follow the filings, the facts, and the fight.

Subject: IN STRONG SUPPORT OF P-1

"I am writing to strongly support Proposal P-1 to Elect the Clerk. Opponents of this measure will claim the current appointed system is more efficient, but the taxpayers of Pierce County know the truth. An office that loses a Deceased Citizen's Final Decree, operates behind bulletproof glass, and has a revolving door of appointed bureaucrats is not efficient. P-1 is explicitly nonpartisan and preserves county administrative support while finally giving the voters the power to hold this vital office accountable. I urge you to vote YES on P-1."

May 16 2016 Order of Adjudication of Intestacy and Heirship, signed in open court by Commissioner Kirkendoll and Clerk Stephanie Meelap, almost 10 years later - it's still not entered into the public LINX docket.

Here's the proof that Commissioner Karena Kirkendoll shredded her signed order and the clerk conspired to delete the Hearing on Order to Show Cause.

I've just uploaded public records related to the ousting of the Pierce County Clerk. www.scribd.com/document/949206164/Pierce-County-Cl… Pierce County needs an elected clerk, not an appointed one, so the people (not the executive) can hold them accountable and cap their term to 4 years.

Just filed a bar complaint against Mary Robnett, Pierce County Prosecuting Attorney.
June 15, 2025
Dear Ms. Robnett,

Please be advised that I have formally submitted a grievance to the Washington State Bar Association’s Office of Disciplinary Counsel regarding your supervisory role under RPC 5.1, and ethical concerns arising from RPC 8.4, as they pertain to the actions of Deputy Prosecuting Attorney Elizabeth Dasse in Estate of Leeanna Ruth Mickelson, Case No. 16-4-00861-8.

A copy of the submitted complaint is attached for your records.

The complaint outlines Ms. Dasse’s unauthorized filing of pleadings and a declaration in a private probate matter where the Prosecutor’s Office lacked standing, directly violating a standing court order (dated 10/13/2017) requiring permission to file. Her interference occurred days before a CR 60(a) hearing before a visiting judge—after an eight-year delay caused by clerical mishandling. This has now further prejudiced the record and undermined the integrity of the court.

Despite multiple attempts to seek resolution, no corrective action was taken, necessitating a formal report to the WSBA.

Sincerely,

Heather Benedict

Dear Chair Hitchen,

This is a courtesy notice that I intend to file a formal recall petition against you no later than Friday, June 20, 2025, after 12:00 PM with the Pierce County Auditor’s Office, pursuant to Article I, Sections 33–34 of the Washington State Constitution and RCW 29A.56.110.

The grounds for recall include:
Failure to initiate or support an investigation into the disappearance of two signed court orders in a probate case.
Approval of a $1 million public payout to Clerk Constance White without any findings of fact, public hearing, or inquiry into the Clerk's role in the missing orders.
Refusal to schedule a confirmation vote for Julie Murray, who has served as acting Clerk without Council confirmation — despite the constitutional and Charter-based mandate.
Allowing the Prosecuting Attorney’s Office to interfere in a private probate matter without standing, six days before a long-awaited hearing, causing delay and obstruction of discovery.

You have been on notice of these constitutional and ethical violations for an extended period. This message serves as a final opportunity to take meaningful action before recall becomes the only recourse left to the public. If no independent investigation is launched or corrective action is initiated by noon on June 20th, I will proceed with formal filing.

The public deserves a transparent and accountable government. Silence and inaction are no longer acceptable.

Sincerely,
Heather Benedict

“Stand and Be Brave” (Parody) https://youtu.be/QUQsqBqxoR4?si=GxDiK...

You can leave me endless forms to file
Push me to the edge, hold back every smile
But I’m rising through each hearing
Despite the fear and smearing,
I’ve got truths that won’t be denied.

Pre-Chorus
Everybody’s been telling me to just back down
But no more hush-hush, no more playing the clown
I see the flaws in the system
And I’m not afraid to list ’em
’Cause silence never changed a thing now.

Chorus
Say what you wanna say
Go ahead, I dare you to stand and be brave
Let your cause ring out,
Pierce County can’t drown you out.
Honestly, I want to see you stand and be brave
With each page you file,
Proving you’re not gonna hide—
Show them you won’t just cave,
I wanna see you be brave.

Verse 2
Courtrooms echo with mistakes from the past
They insisted I keep quiet, but I knew I couldn’t last
They tried to bar my e-filing
But I’m done with their stonewalling
And justice will come if I outlast.

(Repeat Pre-Chorus)

Bridge
And since your truth’s been bottled inside
I can see you ready to testify
You’re stronger than any ban they’ve devised—
So, break free—let the record be your guide.

(Repeat Chorus)

“My Court Fight Song” (Parody) To the tune of "Fight Song" by Rachel Platten https://www.youtube.com/watch?v=xo1VI...

Like a spark in the courtroom,
I’ve been told to stand down.
But I’ve got pages of receipts—
Their errors run me around.
I won’t be hushed by confusion,
Nor an endless e-filing ban,
I’m done crossing my fingers,
Time to make a stand.

Pre-Chorus
I’ve spent years spinning stories
Trying to prove what’s true.
And I’m over the heartbreak,
They can’t silence my view.

Chorus
This is my fight song,
Demanding my rights song,
Confronting the County in plain sight song.
My case is turned on,
Starting right now, I’ll press on strong.
I’m not just one voice,
I’ve got a complaint with cause—
Let ’em hear my fight song,
And I don’t really care if no one else believes,
’Cause I’ve still got a flame left in me.

Verse 2
They tried to bury my proof,
Hide those records on the shelf.
But their contradictory rulings
Just incriminate themselves.
From probate fiascos
To property lost and found—
They said “no estate,” then taxed it—
I will stand my ground.

Pre-Chorus
They mishandled the docket,
Left me drowning in fees.
But I’ll keep on shouting
’Til the court finally sees.

(Repeat Chorus)

Bridge
My e-filing ban’s so unfair,
I’m left to file by hand.
Across state lines, I still prepare,
Refusing to disband.
Yes, the system might be broken,
But my voice remains unshaken—
’Cause I’m done waiting, done waiting...

(Repeat Chorus)
