USCIS POLICY UPDATE — DURATION OF STATUS (D/S)

The administration has submitted a proposed rule to the Office of Management and Budget (OMB) that would eliminate Duration of Status (D/S) for F, J, and I visa holders. If approved, this rule would:

• Replace open-ended D/S status with a fixed end date tied to each student’s program end date
• Require students needing additional time to file a formal extension with USCIS
• Reduce the F-1 grace period from 60 days to 30 days
• Restrict students from changing their educational program or major
• Potentially eliminate USCIS deference to its own prior approvals
This represents a significant reduction in the flexibility that international students have relied upon for many years, and we are acting proactively to protect our students’ status.

Be careful of the reasons you state for the change of status request. If you say that you are seeking F-1 in order to waiting for other type of immigrate visa.

Also be aware that the mere filing of an I-539 change of status may result in USCIS issuing an NTA, i.e. Notice to Appear in removal [deportation] proceedings.

The I-140 regular processing timeline for EB-3 Other Worker petitions is moving much faster than expected. Approvals are being issued in approximately 142 days, which is significantly quicker than USCIS’s estimated processing time of 12.5 months.

The December 2025 Visa Bulletin has been released, and we are pleased to share that nearly all Employment-Based (EB) categories have advanced by 1–2 months for both India and Mainland China.
