Today we are going to explain what IMMIGRATION STATUS is.
Seems pretty straight forward.
You either have a legal status or not, right?
Have you ever heard someone say “their illegals?”
A person is not legal or illegal.
A person has a legal status.
Their legal status is also their immigration status.
Examples of an immigration status are: US Citizen, Legal Permanent Resident (green card holder), Conditional Permanent Resident, Non-immigrant resident, asylee or refugee.
If someone does not have legal authorization to be in the US they are an illegal alien.

I-539 🛩️
Un I-539 es una solicitud que usted presenta a USCIS para extender su estadía en los Estados Unidos o para cambiar su estatus migratorio.
Por lo general, puede permanecer en los Estados Unidos mientras se procesa esta solicitud.
Si llegó a los Estados Unidos con una visa B1 o B2 y desea cambiar su estado al de estudiante, debe presentar un formulario I-539.
Debe cumplir con ciertos criterios, y la escuela debe estar en la lista SEVP para que esto sea aprobado.

I-539 🛩️
An I-539 is an application that you submit to USCIS to extend your stay in the US or to change your immigration status.
You can usually stay in the US while this application is processing.
If you arrived in the US on a B1 or B2 visa and you would like to change your status to that of a student, you would file a form I-539.
You must meet certain criteria, and the school must be on the SEVP list in order for this to be approved.
If you are unsure how to proceed, call our office.
It is better to be told you can't do something than think you can beg forgiveness after doing it, with the US government.
Their forgiveness sometimes turns into a 10-year ban from the country.

NOTICIAS DE ÚLTIMA HORA: La Prueba de Ciudadanía antigua está de vuelta
El 2/22/21 USCIS anunció que la nueva prueba de ciudadanía, que era necesaria para cualquier persona que solicitara convertirse en ciudadano en o después del 1 de diciembre de 2020, va a ser eliminada gradualmente.
Si estudiaste para ello, todavía puedes tomarlo si solicitaste entre el 1 de diciembre y el 28 de febrero de 2021, pero cualquier persona que haya solicitado después de esa fecha tomará el examen más antiguo de 2008
USCIS dijo en su sitio web: "USCIS determinó que el proceso de desarrollo de pruebas cívicas de 2020, el contenido, los procedimientos de prueba y el calendario de implementación pueden crear inadvertidamente posibles barreras al proceso de naturalización".

On 2/22/21 USCIS announced that the new citizenship test, that was required for anyone who applied to become a citizen ON or AFTER December 1, 2020, is going to be phased out.
If you studied for it, you can still take it if you applied between December 1 and February 28, 2021 but anyone after that date will take the older 2008 exam.
USCIS said on it's website: " USCIS determined the 2020 civics test development process, content, testing procedures, and implementation schedule may inadvertently create potential barriers to the naturalization process."

Public Charge ended?
At least for now. A judge in Chicago said that DHS violated the Administrative Procedures Act and so the law is null and void. We are sure DHS will appeal this and who knows how the newly configured Supreme Court will decide but good news for now.

We are sure that you heard!
After numerous universities and 17 states PLUS the District of Columbia filed law suits against Trump and DHS for their new international student policy, they withdrew it.
That means that foreign exchange students should be able to attend schools in the US in the fall, even IF the schools are going to be doing online courses.
This probably isn’t the last we have heard about this topic, so as we learn more, we’ll tell you more.
