In 1919 the Supreme Court decided Schenck v. United States, its first decision on the First Amendment. The court's unanimous ruling in the wartime case allowed the punishment of socialist Charles T. Schenck for distributing pamphlets urging men to resist the draft. Freedom of speech, wrote Oliver Wendell Holmes for the majority, could be restricted if the speech presented "a clear and present danger."

Over the next 100 years, First Amendment law has grappled with ever-changing communications technology and evolving dilemmas. In The Free Speech Century (Oxford University Press, 2019), edited by Law School professor Geoffrey R. Stone, JD'71, and Columbia University president Lee C. Bollinger, they and 16 scholars, including UChicago faculty members David A. Strauss, Laura Weinrib, and Tom Ginsburg, examine the past and future of the free speech doctrine in the United States and around the world. Strauss and Stone discussed our free speech moment at the Seminary Co-op in January.

Ever since Galileo Galilei faced the Roman inquisition in the 17th century for proving that the Earth went round the sun, scientists have risked being ruthlessly silenced. The Autumn 2024 issue of Index examines how scientists to this day still face censorship, as in many places around the world, adherence to ideology stands in the way of scientific progress. We demonstrate how such nations crack down on scientific advancement, and lend a voice to those who face punishment for their scientific achievements. Reports from as far as China and India, to the UK, USA, and many in between make up this issue as we put scientific freedom under the microscope.

Outside of our special report, Ben Lynfield reports on Israel's descent into authoritarianism, Alexandra Domenech writes of the use of punitive psychiatry against Russian dissidents, and Jana Paliashchuk describes the importance of talking about Belarusian political prisoners and not letting them be forgotten. How much of a threat to freedom of speech is the arrest and charging of Pavel Durov?

It really depends what the prosecution's theory is. There's a version of this where I'm not very worried about freedom of speech at all. The version I imagine might be the case is that Telegram was notified about specific posts that contained clearly illegal material, like child-sexual-abuse material, really bad stuff, or known terrorist organizations accounts they knew about specific things and they didn't act to take them down. And the idea that law can require a platform to take down illegal content in that situation where they know about specific things that's pretty common. We have that in U.S. law for the very worst illegal content, and they definitely have it in Europe.

That kind of system, where platforms have a legal obligation to take down stuff they know is illegal, has some threat to freedom of speech. We know that platforms tend to overdo it. That's why you probably don't want a system like that for something like defamation, where people will try to game the platforms by claiming that true reporting is defamation. But if the bottom line is if they knew about child-sexual-abuse material and didn't take it down, having the law penalize that is fine by me. That's not a big threat to freedom of speech.
